Terms of Sale

1. THE CONTRACT BETWEEN US

1.1 These Terms of Sale govern the supply of goods sold by Florinda Apaza Henderson, trading as Incallajta, via the Incallajta website. These Terms of Sale, together with our current website prices, delivery details, contact details, and Privacy Policy set out the whole of our agreement relating to the supply of the goods to you by us. They do not affect your statutory rights as a consumer or other rights granted to you by law.

1.2 On receipt of your order, we will send you an "Order Acknowledgment" by email. This Order Acknowledgment does NOT constitute an acceptance of your order.

1.3 Your order will be accepted only when we receive payment of the whole of the price of the goods that you order, after which we will arrange the despatch of the goods to you.

1.4 Our acceptance of your order brings into existence a legally binding contract between us.

2. PRICE

2.1 The prices payable for the goods that you order are as set out in our website.

2.2 Delivery will be by Royal Mail, and the delivery cost is included in the price quoted on the website. Orders to overseas addresses may be subject to higher charges, which we will advise you of when an order for an overseas address is made.

3. DELIVERY OF GOODS TO YOU

3.1 We will deliver the goods ordered by you to the address you give us for delivery at the time you make your order.

3.2 Delivery will be made as soon as possible after your order is accepted and in any event within 21 days of the Order Date.

3.3 You will become the owner of the goods you have ordered when they have been delivered to you. Once goods have been delivered to you they will be held at your own risk (even though you may still be entitled to cancel the contract) and we will not be liable for their loss or destruction.

4. LIABILITY

4.1 If the goods we deliver are not what you ordered or are damaged or defective or the delivery is of an incorrect quantity, we shall have no liability to you unless you notify us in writing of the problem within 14 days of the delivery of the goods in question.

4.2 If you do not receive goods ordered by you within 30 days of the Order Date, we shall have no liability to you unless you notify us in writing of the problem within 44 days of the Order Date. If you notify a problem to us under this condition, our only obligation will be to refund to you the amount paid by you for the goods in question.

6. GOVERNING LAW

6.1 The contract between us shall be governed by and interpreted in accordance with English Law and the English Courts shall have exclusive jurisdiction to resolve any disputes between us.
Cancellations

1. RIGHT FOR YOU TO CANCEL YOUR CONTRACT

1.1 You may cancel your contract with us for the goods you order at any time up to the end of the 7th working day from the date you receive the ordered goods. This must be done by notifying us in writing. You do not need to give any reason for cancelling your contract nor will you have to pay any penalty.

1.2 Should you receive the goods after you cancel your contract then you must not unpack them, and must send them back to our contact address within 14 days at your own cost and risk.

1.3 Once you have notified us that you are cancelling your contract, any sum paid to us will be re-credited to your account as soon as possible and in any event within 30 days of your order PROVIDED THAT the goods in question are returned by you and received by us in the condition they were in when delivered to you. If you do not return the goods delivered to you or do not pay the costs of delivery, we shall be entitled to deduct the direct costs of recovering the goods from the amount to be re-credited to you.

1.4 Nothing in this clause affects our Returns Policy, which does not form part of this contract.

2. CANCELLATION BY US

2.1 We reserve the right to cancel the contract between us if:

2.1.1 we have insufficient stock to deliver the goods you have ordered;

2.1.2 we do not deliver to your area; or

2.1.3 one or more of the goods you ordered was listed at an incorrect price due to a typographical error or an error in the pricing information received by us from our suppliers.

2.2 If we do cancel your contract we will notify you and we will re-credit to your account any sum deducted by us as soon as possible but in any event within 30 days of the date on which you submit your order to us. We will not be obliged to offer any additional compensation.

Returns Policy

We want you to be completely satisfied with your purchases, and what's more so do the crafts people who have made them. Please let us know if you are not entirely satisfied with our products or our service, so that we can rectify the situation. We try to ensure that the products are the same as our original samples, although sometimes differences do occur. Items are described and photographed as accurately as possible, but please note that sizes, colours and designs may vary. If you are not completely satisfied with any item you ordered, just return it, if possible in the original packaging within 14 days of the date of receipt and we will refund your money or send you a replacement. Please note we are only able to replace identical products (requests for different sizes acceptable), so if you wish to order additional items it will be treated as a new order.

Nothing in this Returns Policy affects your statutory rights or your rights under any contract you may have with us.

Privacy Policy

Your privacy is very important to us and we are committed to protecting the privacy of all personal information obtained from you during your visit to this website. None of the personal information you have provided to us will be shared with third parties. Incallajta is a registered data user under the European Data Protection Act.

We do not store any of your financial details on our site, all payments take place using a third party website www.paypal.co.uk.  This site uses industry-standard encryption methods to transmit your personal registration information from your computer to the Paypal servers across the Internet, and we restrict access to any transactional portions of our site to computers running web browsers that support Secure Socket Layer ("SSL") protocol. To use this protection technology, you need to have an SSL-capable browser, such as Netscape Navigator 4.5 or higher, Microsoft Internet Explorer 4.5 or higher. These browsers will automatically activate the technology when you log on to our Site.

Regardless of the precautions taken by you or by us, "perfect security" does not exist on the Internet. We cannot ensure or warrant the security of any information you transmit to us, and you transmit such information at your own risk.
